Prior to undertaking structural building works or excavations (subject to the depth of the foundations), on or in close proximity to the Party Wall or Party Boundary Fence Wall of an adjoining property, it is necessary that notices will need to be served on all of the affected Adjoining Owners under the Party Wall etc Act 1996 and a Party Wall Award will need to be agreed between each of the Adjoining Owners.
Compliance with the act is a legal requirement and failure by a Building Owner to follow the correct procedures, notifications and agreements may result in legal action being taken thus incurring financial penalties and delays to building projects.
It is important to obtain the advice of an expert Party Wall surveyor as early as possible in the design phase of a project to ensure that the requirements of the Act are fully complied with.
